Welcome to Ailey Shop www.aileyshop.com (the “Website”) operated by Araca Merchandise L.P. (“Araca”, “we”, “our”, or “us”).   This Privacy Policy is intended to inform you about how Araca collects and uses your personally identifiable information (“PII”) and other information in operating the Website.   

The Website offers anonymous browsers (“Visitors”) the ability to learn about Araca’s products. Visitors who are at least eighteen (18) years of age and who register with the Website (“Registrants”) can purchase our products online.  Visitors and Registrants are collectively referred to herein as “you” or “your”. 

By using the Website, you consent to the collection and use of your information by Araca as described in this policy.  We reserve the right to change how we handle the information we collect through the Website at any time.  We will update this Privacy Policy to reflect any changes in how we collect and handle information, and such changes will take effect immediately once posted to the Website.

Registrants must provide certain personally identifiable information (“PII”) to Araca in order to purchase our products. PII includes basic information, such as your name and email address. We may also ask you for general statistical, non-PII about yourself and your interests.

Unless you provide PII to Araca through the Website, we will not collect any PII from you.

Araca may use your PII to communicate offers on merchandise which we believe will be of interest to you, customize our communications to you, administer our business an improve your shopping experience.

Please allow several weeks for us to comply with your Opt-Out Request. Until we are able to process the request we may continue to use your PII as described in this Privacy Policy. After receiving your Opt-Out Request, we may keep your name and other PII on file to fulfill your request, to communicate to you about your account, and for other purposes not related to direct marketing.You can review or change your PII in any of the following ways:

1.      Online.  You can review or update your PII online by signing into the website with your username and password and clicking on any section of the “Your Account” tab.  You can also reach your personal account by clicking here.

2.      By email.  You can submit a request to review or update your PII by sending an email, requesting a copy of your PII or making changes to your PII, to: privacy@aileyshop.com,

3.      In writing.  You can submit a request to review or update your PII in writing  to us at: Araca Merchandise LP, 545 West 45th Street, 10th Floor, New York, NY 10036, USA, Attention: Web Marketing.Araca may provide your PII to entities who work for or with us. These entities may use your PII to help fill your requests in connection with the Website and to help us communicate with you about different resources on the Website. For instance, we may transfer information submitted by you, including PII, to service providers and other third parties who assist us in running the Website and to third party vendors in order to execute transactions requested by you.

We may also release your PII if we believe such release is necessary to comply with the law or a legal process, to enforce our customer agreements, to protect our rights or property, to protect Registrants and/or Visitors from fraudulent, abusive, or unlawful use of the Website, or if we reasonably believe that a danger to any person requires disclosure of your PII. We may also release your PII as part of a corporate reorganization, consolidation, merger, or sale of substantially all of the assets of Araca.

We also collect anonymous and aggregate information from you about your preferences in navigating the Website by using cookies, action tags and other methods. Cookies are small text files that identify your computer. We may use cookies to, among other things, monitor Website usage, customize Website features, identify your computer’s operating system and browser, and complete transactions. An action tag is a small, graphic image on a webpage that is designed to allow the website owner or a third party to monitor who is visiting a website by collecting the IP address of the computer to which the tag is sent, the URL of the webpage that the tag comes from and the time that such webpage was viewed.  Tags may be associated with cookie information. We may also use such anonymous and aggregate information for promotional purposes.

If you do not want to be identified by us, you can set your browser to warn you before accepting cookies and refuse cookies when your browser alerts you to their presence. You can also adjust the settings in your browser to refuse all cookies. If you do not want us to have any of your PII, do not submit any of your PII to us.

Araca takes steps consistent with commercially reasonable industry standards to secure any PII collected from you from loss, misuse, unauthorized access and destruction while under our control. Please note that despite our efforts to protect information provided to us, we cannot guarantee that such information will not be lost, disclosed or accessed by accident or by the unauthorized acts of others.

Araca may provide links to other websites or resources of possible interest to you. Because we have no control over such websites or resources, the collection and use of your PII and other information by such websites shall be subject to the policies and procedures of such websites and not this Privacy Policy.

You must be eighteen (18) years of age or older in order to purchase our products. Araca does not knowingly collect PII from anyone under thirteen (13) years of age.

We reserve the right to make changes to this policy. We suggest users periodically review this Privacy Policy to become aware of any modifications to these terms and conditions. Notice of changes to this policy will be posted on the homepage.
